Wills & Successions
A last will and testament gives you the ability to specifically direct your assets in the manner you prefer to provide for your loved ones when you are gone. Without a will, the default law decides who your heirs are and what they inherit. Drafting a will can be relatively simple and inexpensive, but sometimes it can require more, such as forming a trust. We can assist you in tailoring a will and estate plan that puts your affairs in the specific order that you desire, without burdening those you leave behind. We can also assist heirs, legatees, administrators, and executors in filing and litigating successions and placing heirs in possession of inherited property.
Business Transactions
Succeeding in business often comes down to the decisions made at the outset of any business venture. We advise our clients regularly and can assist you in every step of your business, from creating and amending business charters and operating agreements, to drafting and negotiating asset purchases, leases, buyouts, licensing, confidentiality and noncompete agreements, evaluating contracts, bringing tax appeals, and, when necessary, filing for voluntary or involuntary dissolution. We also have advised officials and managers of private nonprofits and public agencies in conducting day-to-day operations.
Construction
Having represented owners, contractors, subcontractors, engineers, and suppliers in a variety of construction disputes, we can help to protect and properly document your construction project from the submittal of a quote or bid package through the final pay application – and all of the RFI’s, change orders, and contract amendments in between. Documenting the file is the most important thing you can do to avoid or, if necessary, prevail in a construction dispute. We have successfully litigated and arbitrated claims under the Private Works Act, Public Works Act, Public Bid law, Public Lease law, breach of contract, delay damages, and for compliance/noncompliance with public bid specifications.
Property Law
Louisiana’s property laws are unique to the rest of the country. Property owners must not only comply with zoning ordinances and building restrictions specific to certain neighborhoods, but they must also take timely action to prevent any neighbors from acquiring or infringing upon their property. We can assist in any property issues you might have, from entering into a lease or purchase agreement to protecting your rights in property that you own. We have the knowledge and experience to navigate the various procedural hurdles involving partition, boundary, possessory, petitory, quiet title actions, evictions, and building restrictions.
Public Agencies & Regulatory Law
Before beginning his career in law, Dan served on the executive staff of Governor Mike Foster from 1998 to 2004 assisting constituents and advancing the administration’s agenda through the legislative process. That experience has given him a unique insight and perspective into the myriad statutory and regulatory frameworks of public agencies and how they affect the individuals and businesses who must comply with them. Dan has represented governmental agencies to ensure compliance with open meetings and public records laws, the Public Bid law, Public Lease law, the laws on public procurement, the National Environmental Policy Act and the National Historic Preservation Act. He has issued ethics opinions, drafted, reviewed, and approved public bid packages and specifications, reviewed contracts, advised clients on employment matters, opined on the responsiveness/responsibility of bidders, prepared and filed liens/statements of claim, and advanced or defended construction-related claims in arbitration or litigation. That experience can serve not only government officials, but also business and individuals facing zoning and regulatory issues.
